This notice describes how Silverback Commercial Law Services Limited collects and uses
personal data about you both during and after the recruitment process.
What information may we hold about you?
During the recruitment process we may collect and use a wide range of personal data about
you such as the following:
• your contact details such as name, address, telephone number and email address
• your date of birth
• your gender
• your qualifications and previous employment history.
We will only collect and use sensitive personal data (for example about your race or ethnicity,
religious beliefs, sexual orientation and political opinions, trade union membership, health and
sickness records) when we are entitled to do so, for example, when that is with your explicit
consent or if you have manifestly made that information public, or if that is necessary for
prescribed purposes laid down by law.
Where do we get your personal data?
Besides obtaining your personal data from you, we may have also obtained your personal
data from third party sources including your former employers, recruiters, background check
services, our other employees and our clients.
How do we use personal data about you?
We only use your personal data when the law allows, for example:
• Assessing and progressing your application and assessing suitability for the role
(e.g. skills and experience).
• To comply with a legal obligation.
• Where it is necessary for our legitimate interests or those of a third party and your
interests and fundamental rights do not override those interests.
• With your consent.
We will only use your personal data for the purposes for which we collected it unless we
consider that we need to use it for another reason and that reason is compatible with the
original purpose.
If we hold sensitive personal data about you (e.g. health records), we will only use that
information for proper purposes allowed by law, for example to monitor recruitment statistics
and to comply with legal obligations in relation to equality and diversity. We may also collect
information about whether or not applicants are disabled in order to make reasonable
adjustments for candidates who have a disability in accordance with legal obligations in
relation to equality.
Will we share information about you with anyone?
We take your privacy seriously. We will never sell your personal data to anyone, and we take
precautions to keep it secure.
It will sometimes be necessary for us to pass on information to third parties. For example:
• We have legal obligations to pass on to government agencies certain information,
such as tax and National Insurance information.
• We may have a legitimate need to discuss your regulatory status or other information
about you with the Solicitors Regulation Authority or similar authorities.
• We may need to pass on information to service providers, such as our legal advisers.
• We may be audited or checked by third parties in some circumstances, which may
enable them to see some information about you.
Such third parties are required to maintain confidentiality in relation to your information.
We will not send such data outside the European Economic Area (EEA).
How long will we hold your personal data?
We will only retain your personal data for as long as is necessary to fulfil the purposes for
which it was collected. We will generally hold your personal data for the duration of the
recruitment process and a further 6 months to ensure transparency of the fairness or our
recruitment process. In some circumstances we may be required to hold information for a
further period of time due to our legal, accounting, reporting or professional obligations. If you
are not successful, we may ask if you wish your details to be added to our talent bank for
future roles.
Your Rights
Under the UK General Data Protection Regulation, you have a number of important rights that
you can exercise free of charge. In summary, you have the right to:
• Access your personal information and other supplementary information;
• Require us to correct any mistakes or complete missing information we hold on you;
• Require us to erase your personal information in certain circumstances;
• Receive a copy of the personal information you have provided to us or have this
information be sent to a third party, this will be provided to you or the third party in a
structured, commonly used and machine-readable format;
• Object at any time to processing of your personal information for direct marketing;
• Object in certain other situations to the continued processing of your personal
information; and
• Restrict our processing of your personal information in certain circumstances.
